Majority Support Declaration In Fair Work Australia
Last Thursday Fair Work
Australia granted our Majority Support Determination application - Staff have
won the right to bargain, and we have asked your General Manager, Ben Armitage,
to start bargaining with us on Monday 23 August and Tuesday 24 August 2010.
What happens next?
A reasonable employer would now accept the Tribunal
determination that the majority of their staff want to bargain, and would
commence bargaining.
A reasonable employer would stick by the
international undertakings it has given and respect its own employees’ right to
collectively bargain.
A reasonable employer would stick by what management
verbally told staff at your meeting last Monday – that if BMA lost the Majority
Support determination then they would commence bargaining.
A reasonable employer would stick by its own values –
“doing what we say we will do” and
“integrity”, and of course “Win-Win” relationships.
It is now up toBHPCoal/ BMA to show by their own
actions what type of employer they are.
Notice of employee representational
rights letter
BHPCoal/BMA must send out a
“Notice of employee representational rights”
document, asking you to appoint a bargaining representative, or your union in
the next 14 days.
This
letter sets out in details what you need to do, but in summary if you are a member of APESMA, your union will be deemed
to be your bargaining representative for the agreement (unless you appoint
another person as your representative or you revoke the union’s status as your
representative).
If you are not a union
member you can appoint a bargaining representative or APESMA to represent you.
Your staff log of claims for the enterprise agreement
We
will be further consulting with staff to finalise your log of claims in the
next two weeks. The log will build on the results of the surveys staff have
already done. We will also have a meeting of staff - date and time to be
advised. Please also talk to your local APESMA bargaining reps about anything
you would like to see included in our log : Daniel Hull, Patrick Tait and Brent
Stewart.
